Is Oreo Ethical?

Oreo is not automatically an ethical choice because some varieties are suitable for vegans. Its parent, Mondelēz, has a concrete EU competition penalty and substantial criticism over forest-rights safeguards. Cocoa programmes are relevant, but do not guarantee abuse-free supply. What was the €337.5 million fine really for?

In May 2024, the European Commission fined Mondelēz €337.5 million for restricting cross-border trade in chocolate, biscuits and coffee, and for abusing dominance in certain chocolate markets. It found that the restrictions prevented retailers buying freely in cheaper EU countries and helped preserve higher prices. Mondelēz acknowledged liability and received a 15% reduction for cooperation. Commission findings

This is stronger evidence than a complaint about expensive cookies. But calling it an Oreo price-fixing conviction would blur the scope: the decision concerns specified parent-company conduct and product categories, not a finding that every Oreo price worldwide is unlawful.

For shoppers, the issue is whether retailers can compete by sourcing more cheaply. A product can taste exactly as advertised while the business behind it restricts the competitive pressure that should benefit consumers. That belongs in an ethics assessment alongside ingredients and environmental claims.

Are vegan Oreos the same as ethical Oreos?

Oreo’s UK FAQ says many products are suitable for vegans, with possible milk cross-contact, and advises checking allergen information. It also says recipes vary between countries. This supports checking the particular variety rather than treating the entire worldwide range as one recipe. Current UK FAQ

Vegan suitability answers a question about animal-derived ingredients and the applicable standard. It does not establish fair farm incomes, good factory conditions or responsible pricing. Likewise, a cross-contact warning and a deliberate milk ingredient are different things. Use the current package for dietary decisions rather than an old screenshot from another market.

Palm oil: certification is not the end of the enquiry

The UK brand FAQ describes RSPO sourcing, while Rainforest Action Network’s December 2025 assessment placed Mondelēz last among ten companies reviewed for forest and human-rights policies and implementation. RAN identified a particular gap in an explicit zero-tolerance policy protecting human-rights defenders. Our concern is the gap between a purchasing credential and evidence that communities can defend their land safely. A certification claim has value only within its scope. It cannot logically certify every relationship throughout a large company’s supply chain, or eliminate the need to disclose and resolve grievances.

Does Cocoa Life guarantee no child labour?

No such guarantee is established by the programme’s own description. Cocoa Life describes prevention, monitoring and remediation, including identifying children at risk and following up after support. Its published child-protection page reports coverage of 89% of West African Cocoa Life communities by the end of 2024. That is a dated monitoring-coverage measure, not the percentage of cocoa proved free from child labour. Its coverage definition allows a community to count after awareness work and a minimum interview threshold, even when remediation and follow-up have not yet happened. Programme explanation

Mondelēz describes Cocoa Life as its own global sustainability programme, with a planned total investment of $1 billion from 2012 to 2030. Its aims include improving incomes and protecting forests. An investment commitment describes resources and intentions; it cannot establish that every participating household already earns a living income. Company programme position

For a meaningful comparison, ask what proportion of farmers achieve adequate net income, what happens when children are identified, and whether remedies endure. A programme that finds cases should not automatically be judged worse than one that fails to look. Equally, counting interviews is not the same as demonstrating that exploitation ended.

Who receives your money, and what is a fair verdict?

Oreo belongs to Mondelēz International. The parent’s own brand page confirms the connection. Choosing another biscuit should therefore include checking ownership if your concern is corporate conduct, rather than just changing the logo on the packet. Ownership record

There is no evidence here that paying for a premium Oreo variety produces a better social outcome. Compare unit prices for value, and ingredient and sourcing standards for the values you actually want to support. Our cautious verdict rests on the documented competition finding and weaknesses identified in supply-chain accountability, while giving the cocoa programme credit for a defined process rather than a guarantee it does not offer.
